Platform Disclaimer & Safety Governance

1. Non-Party to Trade Contracts

Build-Surety operates strictly as a digital directory and estimation utility. We are never a principal, head contractor, agent, or guarantor for physical site works.

Direct Agreement: All scopes, quotes, and legal contracts form exclusively between property/strata owners and the chosen contractor.
Zero Financial Intermediation: No project deposits, progress claims, or retention funds are handled, held, or escrowed by Build-Surety.

2. Exclusive Site & WHS Sovereignty

Compliance with Work Health and Safety (WHS) laws, site inductions, PPE, plant equipment operation, and hazard controls rests 100% with the active trade.

Independent Risk Control: Contractors execute their own SWMS (Safe Work Method Statements) and safety controls on location.
No Site Supervision: Platform telemetry, cost guides, and estimates do not constitute engineering supervision or occupational safety oversight.

3. Credential & Insurance Scope

Directory badges reflect self-declared documentation and point-in-time checks. Users must independently verify current policy currency before site commencement.

Licensing Check: Active state trade licensing (e.g., NSW Fair Trading / DBP Act alignment) managed directly by the credential holder.
Insurance Currency: Public liability and statutory builder's warranty verifications remain ongoing obligations of contracting parties.

4. Data Isolation & Spam Act Warranty

Direct inquiry routing ensures scope isolation. Contractors uploading prospect/client databases warrant full adherence to Australian communication laws.

Direct Routing: Estimate inputs and project briefs route directly to the selected trade node inbox.
Spam Act (Cth): Uploaders warrant express or inferred consent prior to dispatching marketing communications via uploaded lists.
